01 — Acceptance of Terms

By accessing or using VIV Privé, including its website, mobile interfaces, and concierge services, you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.

02 — Nature of Service

VIV Privé is a guest intelligence and booking coordination platform. VIV Privé connects guests with independent third-party vendors offering activities, dining, transportation, wellness, and related services. VIV Privé does not itself provide any of these services.

03 — Limitation of Liability & Third-Party Vendors

VIV Privé operates exclusively as a guest intelligence and booking coordination platform. All activities, experiences, transportation, dining, wellness services, and any other offerings arranged through VIV Privé are provided by independent third-party vendors. VIV Privé is not a service provider, employer, or agent of any vendor listed on the platform.

VIV Privé makes no representations or warranties regarding the quality, safety, legality, or suitability of any vendor service. By completing a booking through VIV Privé, you acknowledge and agree that VIV Privé bears no responsibility or liability for any injury, loss, damage, dissatisfaction, delay, accident, or incident arising from or related to services rendered by third-party vendors.

In the event of a dispute, complaint, or claim arising from a vendor service, your recourse is solely with the vendor. VIV Privé will make reasonable efforts to assist in communication but assumes no financial or legal obligation in connection with vendor performance.

To the fullest extent permitted by applicable law, VIV Privé's total liability to you for any claim shall not exceed the amount paid for the VIV Trip Pass.

04 — Trip Pass

The VIV Trip Pass grants access to VIV Privé coordination services for a single stay. The Trip Pass fee is non-refundable except where required by applicable law. The Trip Pass does not guarantee the availability of any specific vendor, activity, or service.

05 — Booking & Payment

Bookings facilitated by VIV Privé require a coordination fee collected at the time of booking. The balance for vendor services is due directly to the vendor on the day of service. VIV Privé is not responsible for any additional charges, gratuities, or costs levied by vendors.

06 — Cancellations & Refunds

Cancellation policies are set by each independent vendor. VIV Privé will communicate vendor cancellation terms at the time of booking. VIV Privé coordination fees are non-refundable once a booking has been confirmed. Refunds from vendors, where applicable, are processed according to the vendor's own policy.

07 — User Conduct

You agree to use VIV Privé only for lawful purposes. You must not provide false information, misrepresent your identity, or use the platform in any manner that could damage or impair the service. VIV Privé reserves the right to suspend or terminate access at its sole discretion.

08 — Privacy

Information collected through VIV Privé is used solely to provide and improve the coordination service. VIV Privé does not sell personal information to third parties. Vendor-relevant booking details (name, date, party size) are shared with vendors as necessary to confirm your reservation.

09 — Governing Law

These Terms of Service are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from these terms shall be resolved in the courts of Miami-Dade County, Florida.

10 — Changes to These Terms

VIV Privé reserves the right to update these Terms of Service at any time. Continued use of the platform following notice of changes constitutes your acceptance of the revised terms. The date of last revision is noted at the bottom of this page.
